Details of Trademark Registration

Trademark Registration in Pakistan is governed by the Trade Marks Ordinance, 2001, and the Trade Marks Rules, 2004. The process for registering a trademark in Pakistan is as follows:

Trademark Search: Conduct a trademark search to ensure that the proposed trademark is available for registration. The search can be conducted online through the Intellectual Property Organization of Pakistan (IPO-Pakistan) website or physically at the Trademark Registry.

Trademark Application: Once you have determined that the proposed trademark is available, you can file an application for registration with the Trademark Registry. The application can be filed online or physically at the Trademark Registry.

Trademark Examination: The Trademark Registry will examine your application to ensure that it meets the requirements for registration. The examination process includes checking the distinctiveness and similarity of the proposed trademark with existing trademarks.

Publication of Trademark: If the trademark application is accepted, it will be published in the Trademark Journal for a period of two months. During this time, third parties can file objections to the registration of the trademark.

Trademark Registration: If there are no objections or the objections are successfully addressed, the trademark will be registered and a certificate of registration will be issued. The registration is valid for a period of 10 years and can be renewed for an additional 10-year period.

The fees for trademark registration in Pakistan vary depending on the number of classes for which the trademark is registered. The fees for a single class are lower than those for multiple classes. The process for trademark registration in Pakistan typically takes between 6 to 12 months, but it can take longer if there are any objections or issues that need to be addressed.

It is recommended that you work with a lawyer or trademark agent who is familiar with the registration process in Pakistan to ensure that your application is filed correctly and to address any issues that may arise.
